1. General Terms

These Terms of Service ("Terms") govern your access to and use of Picsnap ("Service"), provided by Perpetio OÜ ("we", "us", or "our").

By accessing or using Picsnap, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

The agreement is concluded upon acceptance of these Terms and runs indefinitely until terminated by either party.

2. Account Requirements

To use Picsnap, you must:

• Be at least 16 years of age and have full legal capacity to enter into contracts
• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Be responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account

Sharing a single account login across multiple users is prohibited unless you have a Business plan that explicitly authorizes team access.

3. Technical Requirements

To use Picsnap, you need:

• A stable internet connection
• A compatible web browser (latest version of Chrome, Firefox, Safari, or Edge recommended)
• Compatible device (desktop, laptop, tablet, or smartphone)

We are not responsible for any limitations, malfunctions, or technical issues with your device, internet connection, or browser. You are responsible for all data transmission costs associated with using the Service.

4. Subscription Plans and Payments

4.1 Pricing and Plans

Current pricing and plan details are available at picsnap.app/pricing. We reserve the right to modify pricing at any time. Changes to pricing will not affect your current subscription period.

4.2 Payment Terms

• All prices are listed as net amounts in USD
• Subscriptions are billed monthly or annually based on your selected plan
• Payment is due at the beginning of each billing period
• We accept major credit cards and other payment methods as displayed during checkout

4.3 Refund Policy

Fees are non-returnable, except for consumers protected by applicable consumer protection laws. If you are a consumer and wish to request a refund, please contact us at hello@picsnap.app within 14 days of purchase.

4.4 Plan Changes

• Upgrades: Take effect immediately, and you will be charged a prorated amount
• Downgrades: Take effect at the end of your current billing period

4.5 Non-Payment

Failure to pay may result in account suspension, content deletion, or account termination. We reserve the right to use collection agencies or legal action to recover unpaid fees.

5. User Content and Responsibilities

5.1 Your Content

You retain ownership of all screenshots, images, and files you upload to Picsnap ("Your Content"). By uploading Your Content, you grant us a limited license to store, display, and share Your Content as necessary to provide the Service.

5.2 Content Warranties

You represent and warrant that Your Content:

• Does not infringe on any third-party intellectual property rights
• Does not contain malware, viruses, or harmful code
• Is not illegal, obscene, defamatory, or hateful
• Does not violate any applicable laws or regulations
• Does not contain personal data of others without their consent

5.3 Content Moderation

We reserve the right to refuse, remove, or delete any content that violates these Terms or applicable law. We may terminate your account without refund if you repeatedly violate these Terms.

6. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or share content that infringes intellectual property rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools (bots, scrapers) without our written permission
• Interfere with or disrupt the Service or servers
• Impersonate any person or entity
• Transmit spam, chain letters, or unsolicited communications
• Use the Service to store or distribute malware
• Reverse engineer, decompile, or disassemble any part of the Service

7. Termination

7.1 Termination by You

You may terminate your account at any time by deleting your account through the settings page. Upon termination, your access to the Service will cease, but you will not receive a refund for any unused portion of your subscription.

7.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• Abuse of the Service
• Business or technical reasons

7.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete Your Content from our servers, though we may retain backups for a reasonable period. Sections of these Terms that by their nature should survive termination will remain in effect.

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Guarantee of Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may experience downtime for maintenance, updates, or unforeseen technical issues.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Consumer Protection

If you are a consumer, you have rights under applicable consumer protection laws that cannot be waived by these Terms. Nothing in these Terms shall limit or exclude your statutory consumer rights. Where these Terms conflict with your consumer rights, your consumer rights shall prevail.

10. Indemnification

You agree to indemnify, defend, and hold harmless Picsnap and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any rights of another party

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict of law principles.

Any disputes arising out of or related to these Terms or the Service shall be resolved through:

• For consumers: The courts of your country of residence, subject to applicable consumer protection laws
• For non-consumers: The courts with jurisdiction over our registered office
